Medical marijuana use in Texas is not legal but is being supported by Rep Harold Dutton, Jr. (D) and Rep. Eliot Naishtat. Rep. Harold Dutton, Jr. (D) introduced HB 184 to have penalties reduced for possession of marijuana in small amounts to a non-jailable offense for those who have no prior convictions of possession. Finally on April 22, 2013, the House Criminal Jurisprudence Committee approved the bill but only for those under 21 yrs of age. Rep. Eliot Naishat reintroduced his bill HB594 that would give those patients suffering from serious illnesses an affirmative defense against small amounts of marijuana possession. This would not protect them from being arrested but it would let that person be able to demonstrate to the judge that they use it for medical purposes.
